With thousands of foreclosures in San Diego and hundreds of thousands of foreclosures throughout the United States many renters are asking “What happens to us if the home we’re renting gets foreclosed on?” First of all a renter should always seek legal advice in this situation because laws are different depending on state and county laws. I have noticed that some banks and lending institutions will give renters relocation assistance in the form of money in a check to move out by a certain date usually less than 30 days.
Some renters I have spoken with have said that the landlord or owner of the home, condo or multi-unit property didn’t say anything to them about the property being foreclosed on. Renters are shocked to find out that the owners were collecting rent at the same time they weren’t making house payments. Property owners know well in advance that the bank is foreclosing on them and should ethically tell the renters what’s going on. Most of the time the renters will lose their deposits as well when the bank takes the property back and the owner disappears. If a renter is unsure about the home or condo they’re renting being a foreclosure or not they can contact a local Realtor – if in San Diego County contact us and we can tell you if a notice of default has been filed on the home or condo you’re renting.
Please be careful when renting another home or condo and find out before you move in if that property is a pre-foreclosure or foreclosure. CNN has a great video about this subject. Please view the CNN News video about renters and foreclosures below.

The real estate market in San Diego for 2009 should be somewhat predictable. In my Real Estate Professional opinion 2009 should look a lot like 2008. 2008 showed us many short sales and foreclosures on the market with declining San Diego home values. We should see the upper end homes continue to drop in price which they have in 2008 but the slide has a lot more to go through 2009. The lower end homes price ranged below $450,000 in many areas of San Diego have started to level off and should continue to level off through 2009. The condos are still dropping in value in most areas of San Diego and inventory of condos in San Diego is building and building. There has to be more movement to lower prices for San Diego condos in 2009.
Some of the unknowns going into 2009 would be the economy and what will the banks do for homeowners other than foreclose on them. The economy in 2009 will be a recession. San Diego will be hit but not as bad as many other areas of the country. We have a large military and federal government job base which will probably not be affected. We have a strong technology base of companies and biotech companies that will help ride out the long recovery. The other factor will be how the banks deal with loans in default. If the banks and mortgage companies decide to allow homeowners to truly refinance their home at a new appraised value and stay in their home this will have a great affect on the San Diego Real Estate Market. It would mean far less foreclosures and short sales and less inventory of homes on the market. In my opinion these will be the two indicators to watch for in 2009.

Just a short time ago there were many people flipping properties here in San Diego. The television show Flipping Out had an episode where Jeff Lewis took a loss on one of his homes he was flipping. The point of that story, to me, was that he wished he would have taken an earlier offer that was much higher. Even a professional in the real estate business can make mistakes and hang on too long. Mistakes will always be made and it’s what you do afterward that counts. I think Jeff Lewis cutting his losses and moving on was a great move that many can learn from.
I too have made some great investments in personal property and investment property. I have also made some bad ones. It’s part of the game. A football team can will the championship without winning every game. No one wins all the time and knowing that is very important if you are going through short selling your home or if your home has been foreclosed on. Get ready for the next game or home purchase. Work on your credit and start saving for your next home or condo. You’ll be ready to buy and lenders will be ready to lend before you know it. Make sure you’re in the game.
If a professional like Jeff Lewis can make a mistake and I have made mistakes and thousands of real estate agents have bought homes they either can’t afford anymore or are upside down $300,000 in, it shows that even people in the business are not immune to market conditions and no one has a real estate crystal ball. The days of flipping will be back one day and for those who love to flip it will be your market.
